2. Purpose
This Legal Notice governs access to, browsing of and use of the Website, as well as the responsibilities arising from the use of its contents, without prejudice to the Owner’s right to modify, without prior notice, the presentation and configuration of the Website, as well as its contents and the conditions required for access to and/or use of it.
Through the Website, the Owner offers users the possibility of purchasing digital content consisting of files in STL format (and other 3D file formats, where applicable) intended for 3D printing, under the terms described in the Terms and Conditions of Sale available on the Website.
3. Status of user
Access to, browsing of and use of the Website confer the status of user, whereby all the conditions set out herein are accepted from the moment browsing of the Website begins. This does not exempt the user from complying with the legal regulations applicable in each case. Users are advised to read these conditions each time they intend to use the Website.
The Owner’s Website offers a wide variety of information, services and data. The user assumes responsibility for making correct use of the Website. This responsibility extends to:
The truthfulness and lawfulness of the information provided by the user in the forms made available by the Owner for access to certain content or services offered by the Website. In any event, the user shall immediately notify the Owner of any fact that allows the improper use of information recorded in such forms, such as, by way of example only, the theft, loss or unauthorised access to identifiers and/or passwords, so that they can be immediately cancelled.
The use of the information, services and data offered by the Owner in a manner contrary to the provisions of this Legal Notice, the law, morality, generally accepted standards of conduct or public order, or that may in any other way infringe the rights of third parties or the proper operation of the Website itself.
4. Intellectual and industrial property of the Website
The Website, including by way of example and without limitation its programming, editing, compilation and other elements necessary for its operation, and the designs, logos, texts and/or graphics belonging to the Website, are the property of the Owner or, where applicable, the Owner holds a licence or express authorisation from their authors, unless otherwise stated. All contents of the Website are duly protected by intellectual and industrial property legislation.
Regardless of the purpose for which they were intended, the total or partial reproduction, use, exploitation, distribution and commercialisation of such contents requires, in all cases, the prior written authorisation of the Owner. Any use not previously authorised by the Owner shall be considered a serious breach of intellectual or industrial property rights.
Designs, logos, texts and/or graphics not belonging to the Owner that may appear on the Website belong to their respective owners, who shall themselves be responsible for any dispute that may arise in relation to them.
The STL files and other digital content offered for sale through the Website are governed by a specific intellectual property and licence-of-use regime, different from that applicable to the elements of the Website itself, which is set out in detail in the Terms and Conditions of Sale. The purchase of an STL file does not imply, unless expressly stated otherwise, the assignment of the intellectual property rights over the design, but rather the granting of a limited licence of use under the terms described therein.
5. Exclusion of warranties and liability for the operation of the Website
The Owner shall not be liable, under any circumstances, for damage of any kind that may be caused by, for example: errors or omissions in the contents, the unavailability of the Website, or the transmission of viruses or malicious or harmful programs within the contents, despite having adopted all the technological measures necessary to prevent this.
The Owner does not guarantee the availability and continuity of the operation of the Website. Where reasonably possible, prior warning shall be given of interruptions to the operation of the Website. Likewise, the Owner shall not be liable for any damage or loss that may arise from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system caused by circumstances beyond the Owner’s control; from delays or blockages in the use of this electronic system caused by deficiencies or overloads in the Internet or in other electronic systems; or from damage that may be caused by third parties through unlawful interference beyond the Owner’s control.
6. Links policy
The Website may redirect users to content on third-party websites. Given that the Owner cannot always control the content published by third parties on their respective websites, it assumes no liability whatsoever for such content. In any event, the Owner states that it will proceed to the immediate removal of any content that may infringe national or international legislation, morality or public order, immediately removing the redirection and notifying the competent authorities of the content in question.
The Owner shall not be liable for the information and content stored, by way of example and without limitation, in forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independently on the Website. Notwithstanding the foregoing, the Owner makes itself available to users and the competent authorities to cooperate in removing, as quickly as possible, any content that may affect or infringe national or international legislation, third-party rights or morality and public order.
7. Personal data protection
The Owner complies with the guidelines of Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD) and any other regulations in force at any given time. All information relating to the processing of users’ personal data, its purposes, legal basis, retention periods and the rights available to users is set out in detail in the Website’s Privacy Policy.
8. General provisions
The Owner will pursue any breach of these conditions, as well as any improper use of its Website, exercising all civil and criminal actions available to it under the law.
9. Applicable law and jurisdiction
The relationship between the Owner and the user shall be governed by the Spanish legislation in force, and any dispute shall be submitted to the Courts and Tribunals of Santa Coloma de Gramenet, unless the applicable legislation provides otherwise.
Where the user qualifies as a consumer within the meaning of Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users (TRLGDCU), the rules on territorial jurisdiction concerning submission to Courts or Tribunals shall apply only insofar as they coincide with the domicile of the consumer user; otherwise, the legal forum corresponding to the consumer’s domicile shall apply, in accordance with consumer protection legislation.
